TERMS OF SERVICE — BRYANT PARK LOFT
1. General Terms
These Terms of Service (“Agreement”) govern the rental and use of Bryant Park Loft (“Venue,” “We,” “Us”) for private events, weddings, photoshoots, and related gatherings (“Event”).
By submitting a deposit or signing the booking confirmation, the client (“Client,” “You”) agrees to all terms listed below.
2. Reservation and Payment
Deposit: A non-refundable deposit of 50% is required to secure the date and services.
Balance: The remaining balance is due no later than one (1) day before the event.
Payment Methods: Payments may be made via credit card, Zelle, or direct invoice.
Confirmation: Booking is confirmed only upon receipt of the deposit and written confirmation from the Venue.
3. Cancellation Policy (Client)
Deposits are non-refundable under any circumstances except in the rare event the Venue cancels the booking for reasons not caused by the Client (see Sections 8 and 9).
If cancellation occurs less than 30 days before the event, the total balance remains due.
One date change may be accommodated, subject to availability and management approval.
4. Use of Space
The Client and guests must respect the property, furniture, and equipment.
The Venue may not be used for any unlawful or hazardous activities.
Candles, smoke machines must be pre-approved in writing.
Setup and breakdown time must be included within the booked time. Additional hours will incur extra fees.
4A. Code of Conduct
Rude, aggressive, or unsafe behavior; harassment; verbal or physical abuse; intoxication; illegal drug use; vandalism; or non-compliance with Venue rules or staff instructions is strictly prohibited.
At our sole discretion, the Venue may refuse service, escort any individual(s) out, or immediately terminate the Event without any refund. The Venue may involve building security or law enforcement where appropriate, and such conduct may lead to legal consequences. The Client is responsible for all related costs, damages, and fees arising from such incidents.
4B. House Rules & Building Policies
To protect guest safety and building operations, the following rules apply and are strictly enforced:
Kitchen & Appliances: Use of the stove is permitted only under Venue staff supervision.
Restricted Areas: Entry to other floors of the building is strictly prohibited.
Fire Exits: Fire exits are for emergencies only. Using a fire exit when there is no emergency is prohibited.
Balconies: No access to any outside balconies.
Staff Areas: No access to employee/staff rooms.
Building Lobby: No gathering, waiting, or holding groups in the building lobby. Meet-ups must occur inside the Loft at the designated time.
Violations may result in immediate removal of individuals or termination of the Event without refund, and may lead to building fines or legal consequences. The Client is responsible for any such fines, penalties, or additional fees.
5. Damage and Liability
The Client is responsible for any damage to the property, décor, or equipment caused by the Client, vendors, or guests.
A security/damage deposit may be required and will be refunded after inspection if no damages occur.
The Venue is not liable for loss or theft of personal belongings.
6. Vendors and Catering
All outside vendors must have COI if working on-site.
The Client must ensure vendors respect load-in/out times and building policies.
If alcohol is served, it must be done responsibly and in compliance with NYC regulations.
7. Noise and Neighbors
Volume levels must comply with NYC noise regulations.
Events must end by the time specified in the rental agreement; overtime fees will apply otherwise.
8. Force Majeure
Bryant Park Loft shall not be liable for delays or cancellations caused by circumstances beyond its reasonable control (e.g., natural disasters, government restrictions, building emergencies).
If a force majeure event makes the Venue unavailable on the Event date, the Client may choose either:
(a) a full refund of all amounts paid (including deposit), or
(b) a one-time reschedule to an available date within 12 months, without penalty.
The Venue is not responsible for incidental or consequential costs (e.g., travel, third-party vendors).
9. Venue-Initiated Cancellation
While this has never occurred, in the rare event the Venue cancels the booking for reasons not caused by the Client and not covered by Section 8, the Client will receive a full refund of all amounts paid, including the deposit. This refund is the Client’s sole and exclusive remedy; the Venue will not be liable for incidental or consequential damages or third-party costs.
10. Indemnification
The Client agrees to indemnify and hold harmless Bryant Park Loft and its staff from any claims, damages, or losses arising out of the event or guest activities.
11. Acceptance
By submitting a deposit or signing this agreement, the Client acknowledges that they have read, understood, and agreed to all the above terms.
